The term ‘Sambiglyon’ or ‘us’ or ‘we’, 'Management' or ‘Island Management’ refers to the company Sambiglyon, whose registered office is Sambiglyon, Old Printers Yard, 156 South Street, Dorking, Surrey RH4 2HF United Kingdom. Our company registration number is 06890732 and is registered in the United Kingdom.
1.1 Our products and services (including any aspect of them, such as specific features and how they function), and the terms and conditions that relate to those products and services are subject to change without notice, and continuing to use our products and services after changes in terms is construed as a continued acceptance of the amended terms.
1.2 Sambiglyon reserves the right to withdraw a product or service from availability at any time and for any reason, or to withdraw the access of individual accounts to Sambigylon products and services at any time and for any reason. The withdrawal of a product or service does not invalidate any outstanding billing amounts on the user's account that remain owing to Sambiglyon.
1.3 Persons under 16 years old are not ordinarily allowed to access Sambiglyon virtual worlds or post messages to Sambiglyon's online website forums. Access to services may be granted for minors aged under 16 if a parent or guardian of that child agrees to be responsible for the child and bound by the terms on their behalf.
1.4 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials of any of our products and services for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law
1.5 Your use of any of our products and services is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information meet your specific requirements.
1.6 You must not attempt to deliberately perform any action designed to hack into or disable a Sambiglyon online service.
1.7 It is not permissible under any circumstances to create an account on Sambiglyon products and services for the purposes of impersonating, insulting, mocking or persecuting other users.
1.8 Our products contains material which is owned by or licensed to Sambiglyon, or is the clearly stated copyright of other individuals/companies. This material includes, but is not limited to, the design, content, layout, look, appearance and graphics.
Reproduction or distribution is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions, and when permission to reproduce and distribute is given for a specific aspect of any product or service. All content may be used only for educational, personal, non-commercial purposes except by arrangement with Sambiglyon or, where Sambiglyon does not own copyright, the copyright holders of the content.
1.9 Any copyright messages contained in content on this site must be included in any reproductions made for non-commercial purposes.
1.10 All trademarks, which are not the property of, or licensed to the operator, are clearly acknowledged.
1.11 Use of Sambiglyon websites that falls outside of the Terms and Conditions may give rise to a claim for damages and / or be a criminal offence.
1.12 You are encouraged to contribute messages and other forms of data to Sambiglyon products and services including but not limited to virtual worlds, websites, blogs and discussion forums. Sambiglyon accepts no responsibility in connection to public submissions or the content of submitted data that is made public on our products and services.
1.13 Sambiglyon services include public areas available to the general public, shared-access areas that are available to individuals that you have selected, and also private areas to which you may not have been granted access.
If you share content with others on Sambiglyon services, in either general public or shared areas, then you acknowledge and accept that individuals with whom you share content may be permitted to make use of that shared content in ways that you are not consulted on and may not agree with. If you do not wish for others to have those rights over your contents then please do not share.
1.14 The use of any offensive, sexually explicit, racially offensive or hateful language in online Sambiglyon products and services is strictly prohibited and will result in permanent exclusion from access to that online product or service.
1.15 The use of offline Sambiiglyon products and services (for example, printed books) to distribute any form of offensive, sexually explicit, racially offensive or hateful language in is strictly prohibited and will result in permanent exclusion from access to Sambiglyon online products and services and the reporting of that person to an appropriate authority.
Sambiglyon are a discrimination-free company who are committed to equal access to its products, content and services for people of all forms of faith, disability, sexuality and ethnicity. Discriminatory actions of any kind that are enacted by one user against another user through Sambiglyon's websites and online virtual reality centers will not be tolerated and constitute a clear breach of our Terms of Service that will result in a temporary or permanent exclusion from access and / or message posting and other contributions to our services.
1.16 The roleplay of combat or violence is not permitted on any Sambiglyon service. All activities must be PG rated. Mature conversation, action or content creation is not permitted and may result in exclusion from access to Sambiglyon services of the individual responsible for that conduct.
1.17 Sambiglyon is not responsible for the accuracy of information provided by contributors and does not endorse the opinions, advice or recommendations of those contributors. By accepting the Sambiglyon Terms of Service, you agree to indemnify Sambiglyon for all claims relating to public submissions. Use of information is at your own risk.
1.18 Except for materials that are licensed by Sambiglyon to the user through their use of our products and services, whether for free or in exchange for payment, Sambiglyon makes no claim of ownership to the content posted or provided to Sambiglyon products and services by the user.
Sambiglyon only claims the right to the distribution of content within the boundaries of the specific product or service that it is contributed to and claims no rights over the distribution of that submission outside of that product or service.
1.19 If you are unsatisfied with or offended by the content of Sambiglyon services then it is your responsibility to cease using those services and, if you have paid in advance for services, seek a termination of contract. The return of unused credit for pre-paid services and the amount refunded, if reimbursement is permitted, is dependent upon the specific terms and conditions of those services.
You agree to indemnify Sambiglyon and its directors, officers, employees and representatives against all losses, harms, expenses, costs and damages that arise from Sambiglyon products and services.
1.20 You may not use another person's account details, such as username and password, to access login-protected Sambiglyon products and services under any circumstances, nor may you attempt to obtain the account details of other users or distribute these details to other persons.
1.21 You agree not to make submissions to Sambiglyon products and services that:
- are threatening, profane, pornographic, unlawful, indecent or incite others to carry out actions that are unlawful under local, national and international laws
- impersonate the identity of another individual in any way or any aspect of the life of that individual. - are slanderous, libelous or violate the privacy of others.
- are intended for the purposes of 'spamming', the commercial promotion of products/services or the solicitation of donations.
- you know to contain viruses, trojans or other malicious data. - violate copyrights or trademarks.
1.22 Contributers to Sambiglyon products and services are agreeing to a license for contributions to be used by Sambiglyon without payment or compensation unless clearly stated otherwise and to modify that information. Sambiglyon agrees in return to grant credit to the originator of the submission and not distribute that information outside of Sambiglyon products and services.
1.23 From time to time, our products and services may also include links to other content including but not limited to websites, videos and virtual worlds. These links are provided for your convenience to provide further information. They do not signify that we endorse the providers of the other content or vet the content so you follow links at your own right.
We have no responsibility for the content of the linked content, their quality or any offense, losses, damages or harms arising from their use. Sambiglyon does not accept responsibility for any personal information collected by these third party websites or contributions submitted to them.
'Second Life' Terms Of Service
2.1 A resident of Sambiglyon's Second Life land rental service must ensure that the time remaining on their rental box is kept in credit. Allowing the box to run into arrears risks termination of the rental agreement and eviction. In the case of eviction all items on the land and that are owned by the resident will be returned to them.
2.2 A resident may place any item on their rented land that is not of of an offensive nature to other residents. Any material that is deemed inappropriate by the Island Management will be removed.
2.3 A resident must not exceed the prim allowance that their land is allocated. If additional object components (commonly referred to as 'prims') over and above the allowance are required by the resident then additional land can be rented if it is available.
If a resident exceeds their prim placement allowance then they will be contacted by the Island Management and politely requested to rent additional land if available or bring their prim usage beneath the level of their present allowance. If the resident does not respond to this request and subsequent reminders then the Management reserves the right to take action to return selected objects to the resident in order to bring the prim usage of that land down to its permitted level.
2.4 If the resident experiences disruptive actions caused by another avatar - often referred to as 'Griefing' - then the resident should report the full name of that avatar to the Island Management. Avatars that persistently have a disruptive action on other users of the Management's land will be banned from land owned by the Management.
The Management is committed to providing the utmost level of safety and security to its residents and users. Use of weapons, vehicles and any other object or anti-social behavior likely to cause inconvenience and offence to residents and users is strictly prohibited and will result in a permanent ban from Sambiglyon virtual worlds for those found to be participating in such objects or behaviors.
2.5 If a resident initiates disruptive action of a malicious nature against other residents or Island users then their rental agreement will be terminated by the Island Management.
2.6 If somebody is bothering you in Second Life or OpenSim then you can open their profile by left clicking on their name in the chat and then clicking the Mute button on the profile window, followed by the Mute Resident button.
Once a person is muted, do not communicate with them again. If you wish to report that person and request that they are banned for their behaviour, you can save a record of your chat or private Instant Message (IM) conversation by opening the IM window or the local chat window with the 'History' button at the bottom of the Second Life / OpenSim window and then highlighting and copying the text into a word processor.
Send a copy of the text to a responsible adult (such as a parent or teacher) or to Island Management. Alternatively, in Second Life but not in OpenSim, you have the option of clicking the Help menu option at the top of the Second Life window and selecting the 'Report Abuse' option to file an abuse report to Linden Lab, the owners of Second Life.
2.7 In rare and exceptional circumstances the Island Management reserves the right to move residents to an adjacent land plot. If this should be necessary then the Management will undertake all land setup and object moving activities on behalf of the resident.
Notice of 30 days will be given, and if the resident would be preferred to be moved to another vacant area on land managed by the Management then whenever possible this will be achieved. 2.8 Residents should not create or place ('rez') objects outside of the boundaries of their rented land except in designated public sandbox areas.
2.8 Residents are permitted to allow other avatars to share their land and contribute towards the rental fees.
2.9 Residents are permitted to sell objects for profit on their land so long as the items are not of an inappropriate nature that offends other users.
2.10 Residents may not enter locked buildings that do not belong to them by teleportation or other means of entry. If the doors are locked then it is the wish of the owner of that building to keep others out. If a resident requests that you leave their land then that request must be obeyed. If the door is open then it may be assumed that entry is permitted by the owning Resident.
2.11 Residents are encouraged to contact the Island Management by email or instant message at any time if they should have questions / complaints or require assistance of any kind.
2.12 Although the Management will listen to valid arguments from residents if they disagree with the judgement of the Island Management, the Management's decision will be final, as the Management has to think of the good of all the residents rather than that of the individual resident.
2.13 It is the responsibility of residents to check their email boxes and Second Life IM messages for notices from the Island Management. If the registered owner of the rented land is going to be away for more than a week then it is their responsibility to either appoint someone to check their email or send the Island Management an 'out of office' message with details of whom to contact in their absence.
The Management cannot accept responsibility for actions that negatively affect the tenant (example: their land being cleared of buildings and objects placed on it after it has run into significant rent arrears due to non-payment) if no contact has been received from the tenant 2 weeks after a notice was sent to them.
2.14 If the owner company of Second Life, Linden Research Inc, cease operation then we shall not be held liable for financial refunds of remaining tenancy contract time. If, however, the land estates operated by the Management should be terminated by the decision of the Management whilst Linden Research and Second Life are still in operation then the Management shall be liable for financial refunds of the total value of remaining tenancy contract time.
2.15 If we should deem it necessary to close an Island then its tenants will be offered a replacement land space on another Island if available as an alternative to a refund of remaining time on their tenancy contract
2.16 Limitations of Liability: in no event shall Sambiglyon (or its directors, officers, employees and representatives) be legally liable for any damages whatsoever, including lost revenue or profits, or other direct / indirect damage, incurred to the contents of land space leased from Sambiglyon, even if they have been advised of the possibility of such damages.
Sambiglyon does though commit to aid in the restoration from backups of damaged content in partnership with the customer. This agreement is governed by the Laws of England.
2.17 Residents who do not comply with the Sambiglyon Terms of Service within Second Life and OpenSim, including the clauses specific to those platforms, may be reported to the Island Management by other users. If you are experiencing serious problems as a consequence of the behavior of another user, you should use Instant Messaging or email to contact the Community Manager to ask for help.
Users that fail to stay within the boundaries of these rules may be warned or ejected from Sambiglyon services, or in more serious breaches of the Terms of Service, they may experience temporary or permanent suspensions from all Sambiglyon products and services.
DISCLAIMER AND LIMITATION OF LIABILITY
3.1 All content of Sambiglyon products and services (including materials, information, features and articles) is provided on an 'As Is' basis without any warranties whatsoever, whether specifically stated or implied. This includes no guarantees of fitness for a specific purpose or merchantability.
3.2 Temporary policies may go into effect at any time for various operations. These will not be listed in this document, but you may be informed of them through other means (for example, announcements and notices). By continuing to use the product or service that the message relates to once informed of changes, you are agreeing to abide by those changes.
3.3 Sambiglyon does not provide support for the use of unapproved third party software in connection with its products and services. This includes bots, proxies and other utilities.
Use of such applications is not prohibited except where that use constitutes a violation of the Sambiglyon Terms of Service and / or disrupts the operation and stability of Sambilgyon products and services but users do so at their own risk and Sambiglyon can accept no responsibility or liability for losses, damages or harms that may result from that usage. This includes but is not limited to data loss, viruses / trojans and impairment of your computer's stable operation.
3.4 Sambiglyon screens its products and its service content for viruses but cannot guarantee that they are free from infection by undetected viral and invasive agents.
3.5 Sambiglyon strives to ensure the accuracy and reliability of its content and corrects mistakes as soon as possible but cannot be held liable in any way, shape or form for mistakes, nor for errors or unreliabilities in submissions made to any and all Sambiglyon products and services by its users. Use of Sambiglyon products and services is wholly at the user's own risk.
3.6 Under no circumstances will Sambiglyon or its partners/affiliates, and the directors, officers, employees and representatives of these organizations, be held liable in any way, shape or form for offence, harm, losses or damages of any kind that result from use of Sambiglyon products and services or third parties linked to Sambiglyon.
This includes, without limitation, incidental, indirect, special, consequential, compensatory or punitive damages resulting from the use of, or inability to use, any form of content, information, materials, messages, opinions, statements, products, services or features, whether it is related to Sambiglyon or a third party.
The above clauses shall apply even in circumstances where Sambiglyon had knowledge of or should have had knowledge about the possibility of the damages to the user.
3.7 Any formal dispute that the user has in relation to Sambiglyon, its products and services or the terms and conditions of those products and services must be registered with Sambiglyon within one year of the cause of the dispute. The user must cease the use of Sambiglyon products and services from the time of the initiation of the dispute onwards.
Acceptance of the Terms of Service at any time from that point onwards shall be assumed to be an acceptance by the user that the dispute is resolved to their satisfaction. This applies to the user and their successors. It also applies to Sambiglyon and our successors and assigns.
3.8 Your use of our products and services and any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales.
3.9 The Contract to which these Conditions apply, unless otherwise stated, shall be governed by and construed in accordance with the Laws of England and the parties submit to the exclusive jurisdiction of the English courts.
